By using the OronCare website, mobile app, or related services (the “Service”), you accept these Terms and Conditions. If you do not accept all terms, do not use the Service. You confirm that you are at least 18 years old. You may also use the Service with a parent or guardian’s permission. OronCare may limit your access. OronCare may also end your use of the Service for any reason.

Services Overview

OronCare offers remote cardiac monitoring. It also offers concierge health services. The Service includes a wearable heart-monitoring device. It also includes a mobile app and a web portal. You can also connect to licensed healthcare providers. These may include cardiologists. They check your health data.

You receive a limited right to use the Service. The right is explained in these Terms. The Service lets you record your heart rhythm data. You can upload this data to OronCare’s secure servers. The Service may also offer extra features. These include priority telehealth consultations. They may also include personal health coaching. You need a paid plan to access these extra features.

All telehealth consultations are provided by licensed healthcare providers. These providers are affiliated with OronCare. They follow all medical and legal standards.

User Obligations

You agree to use the Service in a lawful way. You also agree to follow all rules.

Account Security

You must keep your login details safe. You must also let us know right away if someone uses your account without permission. You are responsible for all activity under your account.

Data Accuracy

You must give the correct personal and medical information. You must also keep this information up to date. You agree to follow all instructions for using the device. You must use the Service only for its intended purpose.

Prohibited Actions

Do not change any OronCare software or firmware. Do not break down or try to copy it in any way. Do not upload harmful code. Do not upload spam or any content that affects the Service. Do not try to collect other users’ personal data. You must not pretend to be someone else. You must not do anything that is unlawful or dishonest.

Third-Party Compliance

You are responsible for any fees you may have to pay. These include fees for mobile data or Internet access. These are charges from third parties. You must also follow any third-party terms. These may include mobile app store rules or network carrier terms.

Medical Disclaimer

OronCare is a tech platform. It does not give medical services directly. All medical services come from licensed healthcare professionals. These professionals are not part of OronCare. Do not use the Service in emergencies. In a medical emergency, call 911. You should also get help right away. The Service only gives general information. It helps you monitor your health. It does not give medical advice.

Using the Service does not create a doctor–patient relationship with OronCare. Licensed providers in the OronCare network handle diagnosis and treatment. You must check their advice with your own doctor. You are responsible for this. OronCare does not guarantee the medical advice you receive. You should not depend on the Service for urgent health decisions.

Device Use and Restrictions

If you receive a device or software from OronCare, you must follow all directions for use. You receive a limited license. You may use the app or software needed for the Service. The license is non-transferable. You must not share this license with others. Do not open or change the device. Do not try to change the software beyond what is allowed. Only use accessories that work with the device. Do not make any changes to the hardware or firmware.

If the Service needs a mobile app, keep it updated. You must update it using official app stores. You must provide your own smartphone. You must also provide your own Internet access. You are responsible for any costs from your provider. These may include data or message charges. OronCare is not responsible for these fees.

Subscription, Billing, and Cancellation

Some features in the OronCare Service require a paid subscription. If you choose a paid plan, you must provide a valid payment method. You allow OronCare to charge subscription fees automatically. Subscriptions renew at the end of each billing period. They continue unless you cancel them.

All fees are non-refundable unless the law says otherwise. We do not give refunds for partial use. We also do not give credits. If we change the price, we will tell you first. You may cancel if you do not accept the new fee.

Intellectual Property

All content on the Service belongs to OronCare or its licensors. This includes text, logos, images, software, and device designs. This content is protected by law. The OronCare name and logo are trademarks. You may not use them without permission.

Limitation of Liability

Where the law allows, OronCare is not responsible for any damages. This includes direct and indirect damages. It also includes accidental, special, and other losses. Examples include loss of data, income loss, or personal injury. This applies even if OronCare has been told that damages could happen.

Some places may not allow full limits on liability. In those cases, OronCare follows the law. If OronCare must pay you, we will not pay more than the total fees you paid in the past 12 months. If the amount is lower than $100, we will pay $100. These Terms do not limit any rights you may have that the law does not let us limit.

Governing Law and Dispute Resolution

These Terms follow the laws of California. If there is a dispute, it will be resolved by binding arbitration. This follows the rules of the American Arbitration Association. By agreeing to arbitration, you give up your right to a jury trial. You also give up the right to join a class action. Arbitration will happen in Santa Clara County, California. Both parties may agree to a different location.

The decision from the arbitrator will be final. You may only ask a court to review it in rare cases. Both sides may go to court for a temporary action. This may be needed to protect intellectual property.
